These Terms and Conditions (hereinafter referred to as "Terms") govern the use of the website www.nutrition-consulting.eu (hereinafter referred to as the "Site") and the provision of nutritional consulting services (hereinafter referred to as the "Services") by Nutriční poradenství s.r.o. (hereinafter referred to as the "Provider", "we", "us", or "our"). By accessing the Site and/or using our Services, you (hereinafter referred to as the "Client" or "you") agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use our Site or Services.

1. Introduction and Scope

Nutriční poradenství s.r.o. is a company registered in the Czech Republic, providing professional nutritional consulting services aimed at improving the health and well-being of its clients. These Terms apply to all users of the Site, including without limitation browsers, vendors, customers, merchants, and/or contributors of content.

These Terms are established in accordance with the relevant laws of the Czech Republic, including but not limited to the Civil Code (Občanský zákoník č. 89/2012 Sb.), the Consumer Protection Act (Zákon o ochraně spotřebitele č. 634/1992 Sb.), and other applicable regulations.

2. Definitions

  • Client: Any natural or legal person who uses the Site or purchases Services from the Provider.
  • Services: All nutritional consulting services offered by the Provider, including but not limited to individual consultations, meal plan creation, dietary assessments, educational workshops, and online programs.
  • Site: The website www.nutrition-consulting.eu and all its associated content and functionalities.
  • Provider: Nutriční poradenství s.r.o., a company providing the Services.
  • Agreement: The contract formed between the Client and the Provider for the provision of Services, governed by these Terms.
  • Personal Data: Information relating to an identified or identifiable natural person, as defined by applicable data protection laws, processed by the Provider.

3. Acceptance of Terms

By using the Site, you acknowledge that you have read, understood, and agreed to these Terms. Your continued use of the Site and/or purchase of Services after any changes to these Terms constitutes your acceptance of those changes. You are responsible for regularly reviewing these Terms.

4. Description of Services

The Provider offers a range of nutritional consulting services designed to assist individuals in achieving their health and dietary goals. These services may include:

  • Individual Nutritional Consultations: Personalized sessions with a qualified nutritionist to discuss dietary habits, health goals, and develop tailored recommendations.
  • Meal Plan Development: Creation of customized meal plans based on individual needs, preferences, and health conditions.
  • Dietary Analysis and Assessment: Evaluation of current dietary intake and its impact on health.
  • Weight Management Programs: Guidance and support for healthy weight loss or gain.
  • Support for Specific Health Conditions: Nutritional advice for managing conditions such as diabetes, cardiovascular diseases, digestive issues, allergies, and intolerances (always in conjunction with medical advice).
  • Nutritional Education and Workshops: Group sessions and educational materials to enhance understanding of nutrition.

The Provider reserves the right to modify, suspend, or discontinue any of the Services at any time without prior notice.

5. Client Registration and Account

To access certain Services or features of the Site, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify the Provider immediately of any unauthorized use of your account or any other breach of security.

6. Ordering and Payment

6.1. Ordering Services

Clients can order Services through the Site or by direct contact via email or phone. Upon ordering, the Client will receive a confirmation of the order, which may include details of the selected Service, price, and payment instructions. This confirmation constitutes an offer to purchase the Services.

6.2. Pricing and Payment Terms

All prices for Services are displayed on the Site and are inclusive of applicable taxes (e.g., VAT) unless otherwise stated. The Provider reserves the right to change prices at any time. However, any changes will not affect Services already confirmed and paid for.

Payment for Services must be made in advance or as otherwise specified in the order confirmation. Accepted payment methods will be displayed on the Site and during the checkout process. Payment can be made via bank transfer or other methods as specified.

6.3. Invoicing

Invoices will be issued electronically and sent to the Client's provided email address. Clients are responsible for ensuring that the email address provided is correct and accessible.

7. Cancellation and Refund Policy

7.1. Cancellation by Client

For individual consultations and packages: If a Client needs to cancel or reschedule an appointment, they must provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee, equivalent to the full cost of the missed appointment, at the Provider's discretion. This policy is in place to respect the time of our nutritionists and other clients.

For digital products (e.g., e-books, online courses): Once a digital product has been downloaded or accessed, it is generally considered non-refundable. However, exceptions may be made on a case-by-case basis if the product is found to be defective or not as described. Please contact us at [email protected] to discuss any issues.

For group workshops or events: Cancellation policies for group events may vary and will be clearly stated at the time of booking. Generally, cancellations made more than 7 days prior to the event will receive a full refund. Cancellations made within 7 days may be subject to a fee or no refund, depending on the specific event and the Provider's ability to fill the spot.

7.2. Cancellation by Provider

The Provider reserves the right to cancel or postpone any Service or appointment due to unforeseen circumstances, such as illness of the nutritionist, technical issues, or insufficient enrollment for workshops. In such cases, the Provider will notify the Client as soon as possible and offer a full refund or rescheduling of the Service at a mutually convenient time.

7.3. Refunds

Refunds will be processed using the original payment method. Please allow up to 10-14 business days for the refund to appear in your account.

8. Client Responsibilities and Conduct

As a Client, you agree to:

  • Provide accurate and complete information about your health status, dietary habits, allergies, and any other relevant details when requested by the nutritionist. This information is crucial for providing safe and effective advice.
  • Be punctual for all scheduled appointments.
  • Communicate any changes in your health status or lifestyle to the nutritionist.
  • Understand that the Services provided by the Provider are for informational and educational purposes only and do not constitute medical advice. The Provider is not a physician, and their advice should not be considered a substitute for professional medical diagnosis or treatment.
  • Always consult with your physician or other qualified healthcare provider before making any decisions or taking any action that may affect your health or treatment.
  • Use the Site and Services in a lawful manner and in accordance with these Terms.
  • Not to engage in any activity that could disrupt or interfere with the proper functioning of the Site or the Services.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Nutriční poradenství s.r.o. or its content suppliers and is protected by Czech and international copyright laws. You may not copy, reproduce, distribute, transmit, display, publish, sell, license, or otherwise exploit any content on the Site for any commercial purpose without the prior written consent of the Provider or the respective copyright owner.

10. Disclaimer of Warranties and Limitation of Liability

10.1. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis without any representations or warranties of any kind, either express or implied. The Provider disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Provider does not warrant that the Site or Services will be uninterrupted, error-free, or free from viruses or other harmful components.

10.2. Limitation of Liability

To the fullest extent permitted by applicable law, Nutriční poradenství s.r.o., its directors, employees, affiliates, agents, contractors, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or Services, or your inability to use the Site or Services, even if the Provider has been advised of the possibility of such damages. This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), or any other legal theory.

In no event shall the Provider's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to the Provider for the Services giving rise to the claim.

The Provider shall not be liable for any loss or damage arising from the misuse of information provided, failure to consult a medical professional, or reliance on information provided by the Provider without proper medical consultation.

11. Privacy Policy

Your privacy is important to us. The Provider collects, uses, and discloses personal information in accordance with its Privacy Policy, which is available on the Site and is incorporated by reference into these Terms. By using the Site and Services, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

The courts of the Czech Republic shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

14. Modifications to Terms

The Provider reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, the Provider will provide reasonable notice prior to any new terms taking effect. What constitutes a material change will be determined at the Provider's sole discretion. By continuing to access or use the Site or Services after any revisions become effective, you agree to be bound by the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the intent and economic effect of the original provision.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other policies or operating rules posted on the Site, constitute the entire agreement between you and the Provider with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site and Services.
